Terms of Service

Agreement to terms
By accessing or using the Palate Party website (palateparty.net), mobile application, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
These Terms apply to all visitors, subscribers, and guests who access or use the Service. “We”, “us”, and “our” refer to Palate Party.
The service
Palate Party is a subscription-based flavor discovery service. Subscribers receive a monthly box of curated, blind-labeled food and beverage products. A companion mobile application enables synchronized group tasting sessions in which participants rate and rank samples before a brand reveal.
The Service has two components:
- Subscription box — a physical box shipped to your address on a recurring schedule, containing blind-labeled tasting samples selected by our team.
- Palate Party app— a mobile application that facilitates live synchronized tasting sessions. Guests who join a host’s party do not need a subscription to use the app, but must accept these Terms and our Privacy Policy.
Accounts
Creating an account
To subscribe you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
You must be at least 13 years old to create an account or participate as a guest in a tasting party. You must be at least 18 years old to purchase a subscription. If you are between 13 and 17, you must have the consent of a parent or legal guardian to subscribe, and by subscribing, you represent that you have obtained such consent.
You agree to provide accurate, current, and complete information and to update it as necessary to keep it accurate.
Account security
Our primary authentication method is passwordless sign-in via magic links. These links are single-use and expire within 15 minutes. You may also set a password on your account. Do not share your magic links, one-time codes, or password with anyone. If you believe your account has been compromised, contact us immediately at hello@palateparty.net.
Subscriptions and billing
Subscription plan
Palate Party is a single monthly subscription. You are charged $10.00 per person per month, multiplied by your group size, plus a flat shipping fee of $6.95 per box. Billing recurs every month on the date you originally subscribed until you cancel.
The total amount due at checkout — including all applicable charges and any taxes — is displayed clearly before you submit payment, and again on every renewal reminder we send.
Discount codes. If you redeem a promotion code at checkout, the discount Stripe applies to your subscription is what you will be charged. Whether the discount applies once, for a limited number of cycles, or to every renewal depends on the code and is shown on your order confirmation and account page.
Pricing may change. We will give you at least 30 days’ advance notice of any price change before it takes effect; existing subscriptions in flight are not retroactively re-priced.
Free trial
We may offer a free trial from time to time. At the end of any free trial period, your subscription will automatically convert to a paid subscription and you will be charged unless you cancel before the trial ends. The amount and frequency of the charge will be disclosed to you before your trial begins.
Payment
Payments are processed by Stripe. By providing a payment method, you represent that you are authorized to use it and authorize us to charge it for the amounts described in your selected plan. If payment fails, we will attempt to process it again and may suspend your subscription until payment is received.
We do not store your full payment card details. Stripe handles all payment card data and is PCI DSS compliant.
We accept major credit and debit cards, Apple Pay, Google Pay, PayPal, Cash App Pay, and Klarna. If you pay using Klarna’s “pay in 4” installment option, your first Palate Party payment is split into four interest-free installments charged every two weeks. Klarna’s approval is required and is subject to Klarna’s own terms. Subsequent subscription renewal charges will be processed to your card on file, not via Klarna installments.
Cancellation
You may cancel your subscription at any time — and cancellation is as easy as signing up. You can cancel from your account page at palateparty.net/account or by emailing us at hello@palateparty.net.
Cancellations take effect at the end of the current billing period. You will continue to have access to the Service until that date, and no further charges will be made after it.
Skipping a month
You may skip one box delivery per billing cycle from your account page. Skipped months are not charged and your subscription resumes automatically for the following delivery.
Refunds and satisfaction guarantee
If you are not satisfied with your first box, contact us at hello@palateparty.net within 14 days of delivery and we will make it right — either by replacing the box or issuing a full refund for that delivery, at our discretion. No proof of fault is required.
After your first box, we do not offer refunds for boxes that have been shipped, except as required by applicable law. If a box arrives damaged or with missing items, contact us within 14 days of delivery and we will replace the affected items or credit your next order.
Shipping
We currently ship within the United States only. Shipping is a flat rate of $6.95 per box per delivery.
You are responsible for providing an accurate and complete shipping address. We are not responsible for boxes that are undeliverable due to an incorrect address provided by you. Address changes must be made before your order is packed; once a box has shipped, address changes are not possible for that delivery.
Risk of loss passes to you when we hand the package to the carrier. If a package is lost or damaged in transit, contact us and we will work with you to resolve it.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Harvest, scrape, or collect data from the Service without our written consent
- Use the Service to transmit unsolicited commercial communications
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Share your account credentials or magic link codes with others or allow others to access the Service through your account
- Use the Service in a way that could damage, disable, overburden, or impair our servers or networks
We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice.
Intellectual property
The Service, including its visual design, brand, content, software, and features, is owned by Palate Party and protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.
By submitting tasting ratings, notes, rankings, or other content through the Service (“User Content”), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content in connection with operating and improving the Service. This includes using your content in aggregate and anonymized form for product research and for the CPG brand partner reporting described in our Privacy Policy. We will not attribute User Content to you by name in any external report.
User content
You retain ownership of any content you submit — including tasting notes, ratings, and feedback. By submitting content, you represent that you have the right to do so and that it does not violate the rights of any third party.
We may remove any User Content that violates these Terms or that we deem inappropriate, at our sole discretion, without notice.
Third-party services
The Service integrates with third-party services including Stripe, Supabase, Postmark, Firebase, Resend, Twilio, Sentry, Amplitude, Axiom, Better Stack, Google Maps Platform, and others. Your use of the Service may be subject to those providers’ own terms and privacy policies. We are not responsible for the practices of third-party services. A list of our current service providers is set out in our Privacy Policy.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
Food and beverage products included in your box are sourced from commercial suppliers and comply with applicable food safety regulations. Products are blind-labeled, but your box will include a complete ingredient list for all products in the box, which is revealed after tasting. You must review all ingredients before consuming any product if you have food allergies, sensitivities, or dietary restrictions. If you have severe or life-threatening allergies, contact us at hello@palateparty.net before subscribing so we can discuss your specific situation. We are not responsible for individual reactions to products.
Limitation of liability
To the maximum extent permitted by applicable law, Palate Party and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or related to the Service shall not exceed the greater of (a) the amount you paid to us in the three months preceding the claim, or (b) $50.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
Indemnification
You agree to indemnify and hold Palate Partyharmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Dispute resolution
Before filing a claim against Palate Party, you agree to try to resolve the dispute informally by contacting us at hello@palateparty.net. We will attempt to resolve the dispute within 30 days. If the dispute is not resolved informally within that period, either party may pursue formal legal action as described below.
You agree that any claim arising from or related to the Service must be filed within one year after the cause of action arose, or be permanently barred.
Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief where necessary to prevent irreparable harm.
Changes to the service or these terms
We reserve the right to modify or discontinue the Service at any time. Material changes to the Service that affect your subscription will be communicated by email with reasonable advance notice.
We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. Price changes will be communicated at least 30 days in advance.
Governing law
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service that cannot be resolved informally shall be resolved in the state or federal courts located in South Carolina, and you consent to the personal jurisdiction of those courts.
Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Palate Party regarding the Service and supersede all prior agreements and understandings.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.
